These Terms and Conditions (“Legal Terms”) are a binding agreement between you (“you”) and kickSTART Nam, doing business as NamEvents (“Company”, “we”, “us”). They govern your access to and use of the NamEvents website kickstartnam.com, and any related services (collectively, the “Services”). By using the Services, you agree to these Legal Terms. If you do not agree, do not use the Services.

1. Our Services
Access from other jurisdictions is at your own initiative and you are responsible for local law compliance. We may update or change features without notice.

2. Intellectual Property Rights
We (or our licensors) own the Services, including all code, design, content, and trademarks (the “Content” and “Marks”). You receive a personal, non‑transferable, revocable licence to access the Services and to download/print permitted materials for personal or internal business use only. Any other use requires our prior written consent.

3. User Representations & Registration
You are 13+; minors must have parental permission.
Provide accurate account details and keep your password confidential.
Do not use automated means to access the Services or for unlawful purposes.
4. Purchases & Payment
We accept Visa and Mastercard. Prices are in Namibia Dollar and may change. You authorise us (and our payment processors) to charge your selected method. We may correct pricing errors and limit/cancel orders suspected to be placed by dealers/resellers.

5. Prohibited Activities
No scraping, reverse engineering, or security circumvention.
No illegal, abusive, deceptive, or infringing content or conduct.
No automated account creation or unsolicited messaging.
No use of the Services to compete with us without permission.
6. User Content & Reviews
If you submit content (“Contributions”), you confirm you have rights to it and that it is lawful and appropriate. You grant us a worldwide, royalty‑free licence to use and display Contributions for operating and improving the Services. We may moderate, edit, or remove content at our discretion.

7. Mobile App Licence & Social Sign‑In
The App is licensed, not sold. Do not decompile or misuse it. If obtained via Apple or Google, their store terms apply in addition to these Terms. If you link a social account, you authorise us to receive permitted profile information per that provider’s rules.

8. Service Management & Availability
We may monitor and manage the Services, remove harmful content, restrict access, and perform maintenance. Availability may be interrupted; we are not liable for downtime.

9. Privacy
Your use is subject to our Privacy Policy. By using the Services, you consent to processing in Namibia.

10. Term, Termination & Changes
We may suspend or terminate access for violations or at our discretion. We may update these Terms; continued use after the revised date means acceptance.

11. Governing Law & Disputes
These Terms are governed by the laws of Namibia. Disputes are subject to the exclusive jurisdiction of the courts of Namibia, without prejudice to any right to bring proceedings where you reside as allowed by law.

12. Disclaimer & Limitations of Liability
The Services are provided “as is” and “as available” without warranties. To the fullest extent permitted by law, we disclaim implied warranties and limit our liability to the amount you paid to us in the 3 months preceding the claim. Some jurisdictions do not allow certain exclusions; your rights may vary.

13. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Services, your Contributions, or your breach of these Terms or third‑party rights.

14. Electronic Communications
You consent to receive notices and records electronically and agree to electronic signatures and transactions with us.

15. Miscellaneous
These Terms constitute the entire agreement. If any provision is unenforceable, the remainder stays in effect. We may assign our rights/obligations. No waiver is implied by inaction.

1. Rental items are subject to availability and equipment will only be reserved upon the signature and return of this contract.

2. Quotes and proposals do not guarantee the availability of rental items. It is recommended that clients sign the contract no later than two weeks prior to the scheduled event date.

3. All rentals are to be prepaid, unless prior credit arrangements have been previously established. No orders will be released until full payment is received.

4. It is the responsibility of the client to provide kickSTART Nam with a final item count seven days prior to event.

Should kickSTART Nam not receive such a revised count, the accepted quote totals will be invoiced.

5. Cancellations or reductions must be made seven days prior to the pickup date. Any cancellations or reductions thereafter will result in the loss of deposits paid pertaining to that specific item.

6. A refundable security deposit is required upon payment. Missing or damaged rental items will be deducted from the deposit at replacement cost.
Any additional cost due to damage or lost items will be for the account of the client and is payable immediately upon the return of the other items.
A detailed invoice of any additional charges will be supplied to the client 7. kickSTART Nam will not be responsible for items lost or damaged at the function. The client should provide any insurance required for their particular event. Responsibility of the rental equipment remains with the client from the time of delivery to the time of pickup.

8. A delivery fee will be charged in the event where the client requests kickSTART Nam to deliver items to any venue at a cost to be quoted.

9. kickSTART Nam will strive to accommodate all client delivery requests; however, delays and changes in scheduling are sometimes unavoidable. We will communicate any schedule changes as they occur in a timely fashion where possible.

10. The client or client’s representative must be available to count all items upon delivery. Should the client’s representative not be available to count the items upon pickup, the count of kickSTART Nam will be considered accurate and missing or damaged rental items will be charged to the client.

11. Our rental equipment is inspected on a regular basis in regards to its suitability of usage. As with any equipment, however, there is a risk that if it is not used as intended, injury could result. kickSTART Nam assumes no responsibility for injury resulting from the misuse of any rental items or equipment.

12. The client will be responsible for all rental items from the time of delivery and/or pick up to the time of return. Precautions should be taken to make sure the rental equipment is secured when not in use and protected from the elements.

13. All rental equipment should be placed in a designated pick‐up location before scheduled pickup time. kickSTART Nam will not pack, gather or search for items at the location.

14. Returned rental items that are permanently stained, burned, have holes or tears, are wet or damp with mildew, are covered with melted wax, or are otherwise unusable, will be billed at replacement cost. A cleaning fee will be assessed for any equipment that is unreasonably dirty upon being returned.

15. The client shall indemnify kickSTART Nam, against and hold harmless from any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorneys’ fees, arising out of, connected with, or resulting from the rental equipment. Client recognizes and agrees that included in the indemnity clause, but not by way of limitation, is client assumption of any and all liability for injury, disability, and/or death to any person or persons in the use, control, or handling of any said rental equipment.

16. The rental of this equipment is to the client indicated below, for the event and specified date indicated on the purchase invoice. This equipment cannot be sub rented or used by others but the client signing below on this contract.

17. If any term or provision of this contract is found invalid, it shall not affect the validity and enforcement of all remaining terms and provisions of this contract.

18. Rentals are for a 24 hour period unless other arrangements have been made. Late fees will be applied. Rentals must be returned before 12:00 on the agreed date.

19. There are no refunds for unused rental items.

20. Prices are subject to change without notice.

21. Courier charges will be for the account of the customer. While kickSTART Nam will take every precaution to pack the items as secure as possible, damages or theft of goods while in transit will be for the account of the client.

22. IT IS THE RESPONSIBILITY OF THE CLIENT TO VERIFY THE CONDITION AND COUNT OF THE ITEMS RENTED BEFORE LEAVING THE

PREMISES OF kickSTART Nam. DAMAGES OR GOODS NOT RETURNED WILL BE CHARGED TO THE CLIENT ACCOUNT.
